BSD Restaurant POS: End User Licence Agreement
Version 1.0 · Last updated 18 October 2026 · Applies to BSD Restaurant POS version 2.3 and later
In short (this summary is not a substitute for the full text below):
- You may try the software free for 15 days. To keep using it you need a paid licence key from BSD Infotech.
- The licence is for one restaurant, on the main PC identified by its Installation Code, for the number of billing PCs in your key.
- Your restaurant's data is yours. It stays on your computers, and we never lock you out of it.
- You are responsible for your tax rates, bills and backups. The software is a tool, not tax advice.
- Indian law applies, and the courts in New Delhi have jurisdiction.
1. This agreement
This End User Licence Agreement ("Agreement") is between BSD Infotech Pvt. Ltd., Hari Nagar, New Delhi 110064, India ("BSD", "we", "us") and the business or person who downloads, installs or uses BSD Restaurant POS ("you"). By downloading, installing or using the software you accept this Agreement. If you do not accept it, do not install or use the software, and remove it.
If you accept on behalf of a business, you confirm that you are authorised to do so.
2. Definitions
- Software: BSD Restaurant POS, including the data service, the billing program, the installer, the user manual and any updates we provide.
- Main PC: the computer on which the data service and the restaurant database are installed.
- Billing PC: any computer that runs the billing program and connects to the Main PC.
- Installation Code: the code shown in SETTINGS > LICENCE that identifies the Main PC.
- Licence Key: the key we issue for an Installation Code, stating your business name, plan and number of Billing PCs.
- Your Data: everything you or your staff enter into the Software, such as bills, menus, customers, stock and settings.
3. Free trial
You may use the Software free of charge for 15 days from its first start on the Main PC, to evaluate it. During the trial every feature is available. When the trial ends without a valid Licence Key, the Software stops creating new bills and KOTs. Reports, backup, restore and the licence screen keep working, so Your Data always stays available to you. Trial use is provided without any warranty (see section 11).
4. Paid licence
When you have paid the applicable fee and received a Licence Key, we grant you a non-exclusive, non-transferable licence to install and use the Software for the internal operation of one restaurant location, on the Main PC identified by the Installation Code and on up to the number of Billing PCs stated in the Licence Key. Unless your plan states otherwise, the licence has no end date for the version you licensed.
If you replace the Main PC or reinstall Windows, the Installation Code changes. Email the new code to support@bsdinfotech.com and we will issue a replacement key under our support terms at that time.
5. What you may not do
- Copy the Software, except for installing it as licensed and keeping backup copies.
- Sell, rent, lend, sub-license or transfer the Software or a Licence Key to anyone else without our written consent.
- Use one Licence Key for more than one restaurant location or more Billing PCs than licensed.
- Bypass, disable or tamper with the trial, the licence check or the Licence Key.
- Reverse engineer, decompile or disassemble the Software, except to the extent the law expressly allows despite this restriction.
- Remove copyright or trademark notices.
- Use the Software for any unlawful purpose, including issuing false or misleading invoices.
6. Ownership
The Software is licensed, not sold. BSD (and its licensors) own all intellectual property rights in the Software, protected by the Copyright Act, 1957 and other laws. All rights not expressly granted to you are reserved.
7. Your Data and backups
- Your Data belongs to you. It is stored on your own computers. The Software does not send Your Data to BSD or anyone else.
- You are responsible for the security of your computers, network and passwords, and for who in your business can use the Software.
- The Software makes backups automatically, but you are responsible for checking that backups are made, keeping a copy away from the Main PC (for example on a USB drive), and keeping your computers in working order.
- Restoring a backup replaces the current data with the data of the backup. The Software makes a safety backup first. You decide when to restore.
- If you send us Your Data for support, we use it only to give that support and handle it as described in our Privacy Policy.
8. Taxes, invoices and legal compliance
The Software helps you prepare bills and reports. It does not give tax or legal advice. You are responsible for:
- the tax rates, HSN codes and tax types you enter (including GST and state VAT on liquor), and for checking them with your chartered accountant;
- the content, numbering, printing and record-keeping of your invoices, and your returns and filings;
- any licences your business needs (for example for serving liquor), and compliance with laws that apply to your restaurant.
Deleting bills or restoring older data can affect your sales records and bill numbers. Use these functions only in line with the law and your accountant's advice.
9. Support, updates and AMC
Support, updates, installation, training and annual maintenance (AMC) are provided as described in your plan or quotation. Unless agreed in writing, we are not required to provide updates, new features or support.
10. Third-party software
The Software runs on Microsoft Windows and uses components of Microsoft .NET and the Microsoft Jet database engine. These are provided under their own licence terms by their owners. Windows and .NET are trademarks of Microsoft Corporation. YouTube is a trademark of Google LLC.
11. No warranty
To the maximum extent permitted by law, the Software is provided "as is" and "as available", without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Software will be error-free or uninterrupted, or that it will meet every requirement of your business. Nothing in this Agreement limits rights that cannot be limited under applicable law.
12. Limitation of liability
To the maximum extent permitted by law:
- BSD is not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, business, goodwill or data, tax penalties or interest, or the cost of replacement software, however caused.
- BSD's total liability arising from the Software or this Agreement is limited to the licence fee you paid for the Software in the twelve months before the claim. For free trial use, BSD's liability is limited to the extent the law allows.
13. Indemnity
You agree to compensate BSD for claims by third parties arising from your breach of this Agreement or from your unlawful use of the Software, including incorrect tax rates or invoices that you entered.
14. Termination
This Agreement ends automatically if you break it and do not remedy the breach within 15 days of our notice. When it ends you must stop using the Software. Your Data remains yours: the backup files and reports stay available to you.
15. Governing law and disputes
This Agreement is governed by the laws of India. The courts at New Delhi have exclusive jurisdiction over any dispute arising from it, subject to any mandatory rights you may have.
16. General
- This Agreement, together with your plan, quotation or invoice, is the entire agreement about the Software. If they conflict, the signed quotation or invoice prevails.
- If a part of this Agreement is found invalid, the rest remains in force.
- We may update this Agreement for new versions. The version published when you download or update the Software applies to that version.
- A failure to enforce a right is not a waiver of it.
